REPRESENTING BOTH CONTRACTORS AND PROPERTY OWNERS IN:

FILING, LITIGATING AND DEFENDING AGAINST MECHANICS LIENS, NEGOTIATING AND DRAFTING CONSTRUCTION CONTRACTS AND DRAFTING AND REVIEWING CONSTRUCTION LOAN AGREEMENTS.

>The Utah Mechanics Lien Laws were drastically changed over the last few years!< In both enforcing Mechanics Liens on behalf of contractors and defending against them on behalf property owners, it has become apparent that contractors and even many of their legal representatives do not understand the filing and litigation drafting requirements now required to successfully obtain the funds and priorities the lien law allows the contractors if the legal work is done properly.

This Firm has met with success in properly implementing these laws and defending against those liens that were improperly filed and/or prosecuted.

The best way to avoid costly litigation over contract disputes is to have a well drafted Construction Contract at the outset. The firm has had wide experience in negotiating and drafting such contracts, and litigating or arbitrating costly construction contract disputes that could have been avoided if a well drafted construction contract had been executed.

Construction Loan agreements favor the Lender, and safeguards to protect the property owner - Developer is a prudent, cost saving endeavor to avoid future unanticipated costs and construction delays.
